Reservation terms & conditions
These Reservation terms & conditions, including any revised Reservation terms & conditions that we may post from time to time, state the terms & conditions under which Grand Hotel Huis ter Duin (“Huis ter Duin”, “GHHTD”, we”, “us”, “our”) will provide hotel accommodation to you (“you”). Please read these terms and conditions carefully.
1. Definitions
1.1 Unless the context otherwise requires, any capitalized terms used in these terms and conditions have the following meanings:
– “Accommodation” means your requested hotel stay.
– “Reservation” means a reservation made by you for Accommodation at the Hotel, whether made via our online reservation system, direct or otherwise.
– “Charges” has the meaning given to it in clause 4.1.
– “Force Majeure” means an unforeseeable, unavoidable event beyond a party’s reasonable control, including fire, storm, earthquake, tsunami, flood, hurricane or other act of God, explosion, casualty, strike, unavoidable accident, riot, insurrection, civil disturbance, act of public enemy, act of terrorism, embargo, war, inability to obtain labor, materials or supplies, economic downturn, social or political factors, any outbreak of disease, epidemics, quarantine restrictions, public health restrictions, any governmental regulation, disruption to local, national or international transport services, restriction or prohibition or any other similar cause. “Hotel” means the Grand Hotel Huis ter Duin.
– “Terms and Conditions” means these Reservation Terms and Conditions, as may be amended by us from time to time.
– “Representatives” has the meaning given to it in clause 11.2.
2. Reservations
2.1 You must be at least eighteen (18) years old to make a Reservation.
2.2 You may make a Reservation by using our online reservation system, directly in person or by phone, or via other channels e.g. our call centers and travel agents. Rooms are subject to availability and any applicable taxes and/or service charges as advised during your Reservation process.
2.3 Guaranteed Reservations
2.3.1 In order to secure/guarantee your Reservation you are required to provide a deposit or a valid credit card depending on your applicable Accommodation rate.
2.4 In accordance with the rules and regulations of the country, all guests have to be registered, with valid proof of identification provided (passport or national ID).
2.5 You do not acquire the right to the availability of a specific room. Huis ter Duin reserves the right to substitute your Reservation for a similar or a better room category at the Hotel or to relocate your Reservation to another hotel of the same or higher standard, at no additional cost to you, if the room category specified in your Reservation is unavailable.
2.6 Huis ter Duin may cancel your Reservation at any time, without prejudice to any other right it may have: (a) if you are in breach of any of these Terms and Conditions; (b) for security purposes; (c) by order of the Government or any public authority; or (d) due to an event of Force Majeure.
2.6 Non-Guaranteed Reservations
2.6.1 Huis ter Duin considers a non-guaranteed Reservation (6 PM Reservation) not binding and may, without the obligation to inform you prior to your arrival, sell the room to another arriving guest.
2.7 Reservations through third party booking sites
2.7.1 Reservations created through third party booking sites like Booking.com, Expedia.com,Hotels.com etc. remain your responsibility. All data entered through these sites are electronically processed at Huis ter Duin and don’t allow manual alterations by Huis ter Duin.
2.7.2 Changes to reservations created through third party booking sites, as mentioned in paragraph 2.7.1 can’t be made by Huis ter Duin and can solely be performed under your own account through the selected booking site.
2.7.3 Huis ter Duin will reject any request for modification of a reservation created through a third party booking site in order to avoid improper handling of the reservation at both the booking site as well as within Huis ter Duin.
2.7.4 Huis ter Duin is willing to transfer your reservation to a reservation directly made at Huis ter Duin under the assumption that you cancel your reservation at the selected booking site and provide a cancel confirmation of such action to Huis ter Duin.
3. Check-in and Check-out Times
3.1 Huis ter Duin’s standard check-in time is 15:30hrs and check-out time is 11:00hrs. The times may slightly vary, depending on the Hotel and the rate booked. You will be advised of your exact check-in and check-out time during your Reservation or Check-in process.
3.2 If you would like to extend your check-out time, please contact the reception desk.
3.3 Early Departure Fee: please note that in case you decide to depart earlier than reserved, the Hotel will charge for the full stay reserved and booked unless otherwise specified in the cancellation policy of your Reservation.
4. Payment
4.1 Charges, including your outstanding Accommodation charges, if any, and any other charges, such as room service, mini-bar and any meals charged to your room (“Charges”) are payable on presentation of an invoice for such Charges (Cheques are not accepted). You agree to be personally liable for all Charges incurred.
4.2 At check-in you will be required to provide a security deposit equivalent to the sum of your outstanding Accommodation charges, if any, and applicable taxes for the entire stay and an additional fixed amount to cover potential incidentals as advised by the Hotel per day per room in the form of a cash deposit or credit card pre-authorization.
4.3 Foreign currency cannot be taken as a cash deposit unless exchanged into the local currency at then existing Hotel rates and the balance returned in local currency. For credit card payment, pre authorization will be taken upon arrival and once the outstanding Charges exceed the pre authorization, the exceeding amount will be taken accordingly and additionally authorized without prior notification.
4.4 All Charges have to be settled upon check-out at the latest. If for any reason you do not pay the Charges (or any part of them) upon check-out, then you acknowledge and agree that we may charge the outstanding Charges, if applicable, to your credit card without prior notification.
4.5 Payments made with € 200 or € 500 notes are subject to a bank processing fee of € 5 per note deposited. This fee shall be charged directly to the guest. In compliance with applicable banking and regulatory requirements, the Hotel and its affiliated restaurants are also required to register the origin of such notes by collecting the guest’s name and identification number. The information collected will be used and retained solely for internal administrative and compliance purposes.
5. Taxes
Your Reservation may be subject to fees and taxes in the relevant jurisdiction. As a result, you will be required to pay such fees and taxes (including but not limited to VAT) as applicable and in accordance with the existing legislation or any legislation that may be introduced in the future. Any tax liability, including disclosure, connected with your Reservation will be your responsibility.
6. Cancellation /no-show/Changes & Upgrades
6.1 Cancellations
6.1.1 Cancellations made up to 2 days before the scheduled arrival date (Cancellation Policy) will receive a full refund unless otherwise mentioned on your Reservation confirmation.
6.1.2. Cancellation made within 2 days of scheduled arrival will incur a cancellation fee equivalent to the first night stay unless otherwise mentioned on your Reservation confirmation.
6.1.3 You acknowledge and agree that, if applicable, we may charge the cancellation fee to your credit card.
6.1.4 The actual cancellation policy is related to the rate you’ve selected in your reservation and will be printed on your Reservation confirmation. If no cancellation policy is printed the default policy as outlined under 6.1.1 and 6.1.2 will be applicable.
6.2 No-Show
6.2.1 Huis ter Duin will consider your Reservation a no-show at 23:00 on the scheduled day of arrival and will charge a no-show charge to your credit card or deposit unless you indicated a late arrival during the Reservation process.
6.2.2 You acknowledge and agree that, if applicable, we may charge the fee for the no-show to your credit card.
6.2.3 In case of a no-show the remainder of the Reservation will be cancelled
6.3 Changes/Upgrades to your Reservation
6.3.1 Certain changes/upgrades to your Reservation, including but not limited to Arrival Date, Departure Date, number of nights, Room Type, number of Adults and/or number of Children, may result in a change of your initial rate
6.3.2 Amendments to a Reservation based on a BAR (Best Available Rate) and subject to changes as outlined in paragraph 6.3.1 may result in a higher BAR rate subject to the active BAR rate at the moment of the Amendment.
6.3.3 Reservations based on Promo rates are restricted from certain Amendments. The Promo is based on the initial Reservation information including but not limited to the period in which the stay is consumed.
6.3.4 You acknowledge and agree that, if applicable, we may charge the difference for the amendment of your Reservation to your credit card.
7. Right of Refusal
We reserve the right to refuse you or any of your visitors, entry to the Hotel and cancel your Accommodation if, on arrival, we consider that you or your visitors, are under the influence of alcohol or drugs, are unsuitably dressed or are behaving in a threatening, abusive or otherwise unacceptable manner.
8. Your behavior
8.1 We reserve the right to require you or any of your visitors to immediately vacate your room, check-out and leave the Hotel premises if we consider that you are behaving (or have behaved) in a threatening, abusive or otherwise unacceptable manner which could trigger (or has triggered) a risk to the safety and health of other guests or staff of the Hotel or are causing (or have caused) a disturbance or annoyance to other Hotel guests or staff of the Hotel.
8.2 You must comply, and must ensure that all of your visitors comply, with all reasonable rules and procedures in effect at the Hotel and notified to you, including but not limited to health and safety, security procedures and any other legal requirements.
8.3 Under no circumstances may you take photographs of the Hotel premises to sell or for any other commercial purpose.
8.4 With the exception of infant food or unless explicitly approved by the Hotel, neither you nor any of your visitors may bring your own food or drink into the Hotel for consumption at the Hotel.
8.5 You may not, and must ensure that any of your visitors do not, enter areas of the Hotel which are indicated as being closed to the public.
8.6 Please be advised that smoking is not permitted in the Hotel, except in expressly designated areas. A fee equivalent to EUR 125 for cleaning and deodorizing the room and furniture may apply for smoking in any other Hotel room.
8.7 Subject to Hotel’s approval and payment of a EUR 125 (or the equivalent amount in local currency at an exchange rate to be reasonably determined by us) damage deposit, pets are allowed at the Hotel. Pets shall not be left unattended in your room unless notified to front office and housekeeping. Pets or other animals are not allowed at Hotel restaurants. The deposit less any deduction for damages, if applicable, will be refunded upon check-out.
8.8 Children under the age of 14 must be supervised by an adult at all times.
9. Property damage/loss
You are responsible for any loss or damage to Hotel property, furnishings, fittings or equipment (including, without limitation, towels and linen), caused by you or by any of your visitors. Amounts required to remedy any damage caused will be charged at your sole expense in accordance with clause 4.
10. Pool
Please be advised that the use of the pool, spa and health clubs is at your own risk. Huis ter Duin cannot be held responsible for any form of personal injury, loss, damage, or death caused by the usage thereof (except that nothing affects the liability of Huis ter Duin for death or personal injury caused by Huis ter Duin’s gross negligence or willful misconduct or any other liability which may not be excluded or limited by law).
11. Valuables
11.1 Money, jewelry and other valuables are brought to the Hotel at your own risk and must be placed in the safe deposit box available in your room or at the reception.
11.2 To the extent permissible by any applicable law, no responsibility is accepted by Huis ter Duin, Huis ter Duin’s legal representatives or persons used to perform an obligation of Huis ter Duin (including our employees, affiliates, partners and agents) (“Representatives”), Huis ter Duin’s affiliates and Representatives of Huis ter Duin’s affiliates for loss or damage to any guest property which is not placed in a safe deposit box, except where such loss or damage is caused by the gross negligence or willful misconduct of Huis ter Duin, Huis ter Duin’s Representatives, Huis ter Duin’s affiliates and Representatives of Huis ter Duin’s affiliates.
11.3 The liability of Huis ter Duin, Huis ter Duin’s Representatives, Huis ter Duin’s affiliates and Representatives of Huis ter Duin’s affiliates for loss or damage to any guest property which is placed in a safe deposit box shall be limited to EUR 3,500 except where such loss or damage is caused by the gross negligence or willful misconduct of Huis ter Duin, Huis ter Duin’s Representatives, Huis ter Duin’s affiliates and Representatives of Huis ter Duin’s affiliates.
11.4 You must report any loss of or damage to your property immediately upon discovery, and must make yourself available to assist with any reports made by us to the police. Huis ter Duin shall have no liability to you if you fail to submit such notice immediately or you fail to assist with any reports to the police.
12. Visitors
For each visitor an additional occupancy charge in accordance with your applicable Accommodation rate will be added to your Accommodation charge.
13. Pets
13.1 Pets may be welcome under certain conditions, at the discretion of the Hotel. Please check with the Hotel before booking any services.
13.2 For hygiene reasons, unless otherwise indicated by the Huis ter Duin, pets are not allowed in eating areas or, as applicable, at the spa, the fitness center and swimming pool.
13.3 In any case and unless otherwise indicated, pets must be kept on a leash in the common areas of Huis ter Duin.
13.4 Pets may not be left alone in the room or unattended when their owner leaves the premises of Huis ter Duin. It is also necessary to ensure that they do not cause any damage to the room or its furnishings, or disturb the peace and quiet of the establishment under any circumstances.
14. General
14.1 To the extent permissible by any applicable law, Huis ter Duin excludes all liability and responsibility for Huis ter Duin, Huis ter Duin’s Representatives, Huis ter Duin’s affiliates and Representatives of Huis ter Duin’s affiliates for loss or damage of whatever nature arising from or in connection with your Hotel stay, regardless of whether such loss or damage would arise in the ordinary course of events or otherwise, is reasonably foreseeable or otherwise, or is caused by any error or omission of Huis ter Duin, Huis ter Duin’s Representatives, Huis ter Duin’s affiliates and Representatives of Huis ter Duin’s affiliates (whether negligent or not), except that nothing affects the liability of Huis ter Duin, Huis ter Duin’s Representatives, Huis ter Duin’s affiliates and Representatives of Huis ter Duin’s affiliates for death or personal injury caused by the gross negligence or willful misconduct of Huis ter Duin, Huis ter Duin’s Representatives, Huis ter Duin’s affiliates and Representatives of Huis ter Duin’s affiliates or any other liability which may not be excluded or limited by law.
14.2 Huis ter Duin will not be liable to you or any of your visitors, for any loss or damage to property caused by the misconduct or negligence of another guest.
14.3 Huis ter Duin will not be liable to you for any failure or delay in performing any of our obligations if the failure or delay was due to an event of Force Majeure.
14.4 If any provision of these Terms and Conditions is deemed unlawful, void or for any other reason unenforceable, then that provision shall be deemed severed from the Terms and Conditions and shall not affect the validity and enforceability of any other provisions.
14.5 Huis ter Duin ‘s failure to exercise or enforce any rights or provisions of the Terms and Conditions will not constitute a waiver of such rights or provisions.
14.6 Nothing in these Terms and Conditions shall create a contractual relationship with, or cause of action in favor of, any third party. Any rights of any third party to enforce these Terms and Conditions under any applicable legal principle, statute or otherwise are excluded.
14.7 General words shall not be given a restrictive interpretation by reason of their being preceded or followed by words indicating a particular class of assets, matters or things.
